A federal judge on Wednesday dismissed the civil lawsuit filed against a former sexual enhancer maker after a jury found the company failed to adequately warn about the potential for sexual adverse effects in men taking the drug. The lawsuit alleges the company failed to properly disclose the risks of Viagra.
The suit claims the plaintiff did not properly warn about the risks of Viagra because the drug has been used for a number of years by men who have experienced sexual dysfunction, including erectile dysfunction. The company also failed to warn consumers or health care providers of the possible increased risk of heart attack and stroke.
The suit alleges that in 2009, the U. S. Food and Drug Administration warned men not to use the drug because of the possible sexual side effects and advised them not to take the drug because of the increased risk of stroke. The FDA also warned the FDA that erectile dysfunction could be a warning sign of heart disease or diabetes, which could lead to heart attacks and strokes.
“It is important to note that sexual dysfunction can have an adverse effect on a man’s quality of life and negatively affect his ability to get or keep an erection,” Judge Michael L. Reitman said. “These findings were a failure to properly warn of the increased risk of sexual adverse effects and its association with heart disease.”
The plaintiff’s attorney, Michael A. Gass, argued in a letter to the judge that the company should have adequately disclosed the risk of cardiovascular events in patients taking the drug.
“The FDA is the authority behind this letter, and the U. Attorney’s Office is responsible for prosecuting this case. We believe the FDA has the authority to do what is best for the public,” Mr. Gass wrote in the letter.
Mr. Gass noted that the plaintiff’s lawsuit seeks damages for personal injury resulting from the company’s failure to warn about the risk of sexual adverse effects. The plaintiff’s attorney argued that the plaintiff should be allowed to recover damages for his wife’s loss of consortium.
The judge dismissed the lawsuit with prejudice.
