Pfizer Inc. has filed a complaint with the Food and Drug Administration seeking a temporary restraining order on the sales of its prescription drugs, including Viagra and Levitra.
The FDA had asked Pfizer to block the sale of its products to the company’s sales force and to allow the company to list sales data on them.
The FDA’s action was announced in a notice of opposition filed by the pharmaceutical company on June 27, 2005.
FDA spokeswoman Cindy Whitehead said the company had no comment.
The complaint was filed by the pharmaceutical company on June 23, 2005.
The complaint alleges the company failed to adequately warn consumers about the risks of Viagra and Levitra, and that the product was not intended for sexual activity.
The complaint also states that Viagra and Levitra were not marketed for the purpose of treating erectile dysfunction and that the FDA had not evaluated whether Viagra or Levitra would be approved for that purpose.
The FDA’s complaint seeks a temporary restraining order on the sales of the products.
“Because Pfizer had no knowledge of any of these alleged violations of law, the complaint will not be considered a complaint under any federal or state law,” said FDA spokesman Frank D. Miller.
“Pfizer is seeking to have the complaint, including those of its subsidiaries, removed from the market and dismissed,” said Miller.
Pfizer was also asked to list the sales of the products, and the company was seeking to withdraw a proposed settlement with the FDA and to allow a public hearing on the lawsuit.
“The public has a right to know whether these products were marketed and sold to consumers for the purpose of treating or preventing a disease,” said Miller.
Pfizer also is seeking injunctions against any of its sales representatives.
Pfizer said it was not aware of any cases or information regarding the sales of its products.

The complaint also seeks a prohibition order against any Pfizer executives, acting or acting as a corporate representative, and a prohibition order against Pfizer executives.
